FAMILY HEALTHCARE DISCOUNT PLAN WEB SITE AGREEMENT.
Please read the following carefully before accessing or using this service. By accessing or using this service, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you should not access or use this service. Family Healthcare Discount Plan may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modifications.
The Family Healthcare Discount Plan web site is an online information and communications service provided by our site, subject to your compliance with the terms and conditions set forth below.
THE FAMILY HEALTHCARE DISCOUNT PLAN CARD
Your membership card is a discount card only, and not an insurance, prepaid healthcare, referral or other similar plan. Family Healthcare is not an insurance product, health maintenance organization or a health care administrator and is not responsible for establishing the participating provider fees or for assuring access or quality of care.
YOUR MEMBERSHIP CARD
Your Family Healthcare membership card is not transferable. You, your spouse and immediate family members, are the only persons permitted to use the card. You acknowledge that unauthorized use of your membership card may result in the immediate cancellation of your membership. Whenever you receive healthcare services or products to which a Family Healthcare membership discount applies, you must present your Family Healthcare membership card at the time of service.
If you lose your membership card, you must immediately report its loss to our Member Services at: memberservices@successfulprofessional.com
NOT AN INSURANCE PLAN
Family Healthcare Discount Plan is a discount membership program only and is not an insurance plan. Family Healthcare Discount Plan does not guarantee, nor is it responsible for the quality of care or products provided by any provider. Family Healthcare Discount Plan providers are subject to change without notice.
DISCOUNTS
Program savings are based on the provider's regular fees or the national average fees for the same service or product. Your actual savings may vary depending upon the provider's location and the specific services or products you purchase. The discounts provided may not be used in conjunction with any other discount plan or program.
PRICING
All listed or quoted Family Healthcare Discount Plan prices are current prices only and are subject to change without notice. From time-to-time providers may offer certain products or services to the public at promotional prices that are lower than the Family Healthcare Discount Plan price. In such an event, Plan members will be charged the lower price.
MODIFICATIONS
The Family Healthcare Discount Plan program may be modified at anytime. Should you choose to cancel your membership as a result of a modification, the liability of Family Healthcare Discount Plan will be limited to the refund of any membership fees paid for the period subsequent to the modification.
BENEFITS/DISCLAIMER OF LIABILITY
All services and products are subject to their availability and you are solely responsible for your selection of any provider, service or product and for the cost of any services obtained or products purchased by you or your family from participating providers. You agree on behalf of yourself and all users of your membership card and your and their heirs and personal representatives that Family Healthcare Discount Plan and its sponsors (collectively, "We" or "Us") are not responsible or liable for any of the services or products provided by the participating providers or for their performance, and that if you or any other of the aforementioned parties have any claim relating to any services or products obtained through Family Healthcare Discount Plan you or they will make such claim against the actual provider of the service or product and not against Family Healthcare Plan or any of its affiliates, officers, directors or employees. Family Healthcare Discount Plan does not recommend or endorse any participating provider. You acknowledge that we make no warranties, express or implied, with respect to any of your membership benefits, the health products or services purchased by you through your membership card, or related information provided to you. You agree that we will not be responsible if any provider fails to honor, or withdraws from, its agreement with the provider network. In all above instances you acknowledge that your sole recourse will be the cancellation of your membership. Under no circumstance will liability to you (or anyone else using your membership card) exceed the amount you have paid for your current membership. No liability is assumed by us for administering claims for discounts or any other dispute between you and the participating provider, or for any inaccuracy or omission with respect to the description of any discounts, product, service or provider. However, if you do encounter a problem with any discount, Family Healthcare Discount Plan will try to address your concern. Family Healthcare Discount Plan reserves the right to eliminate, add, change and substitute membership benefits and the providers of such benefits without notice, and to increase the membership fee for any future membership term upon providing you with at least thirty days advance notice.
NO EXPRESS OR IMPLIED WARRANTIES
Family Healthcare Discount Plan does not make any express or implied warranties, representations or endorsements whatsoever with regard to the service, merchandise, or information provided through the service or on the Internet generally, and Family Healthcare Discount Plan shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the service or on the Internet generally.
CONTINUED COVERAGE
To ensure continued healthcare coverage for you and your family, unless cancelled by you or Family Healthcare Discount Plan, your membership will automatically renew each billing period. Each renewal of your membership shall constitute a separate and distinct membership contract for the period covered.
MEMBERSHIP TERM
Your membership is effective for the period covered by your membership fee payment and continues upon your payment of the (monthly/annual) renewal fee automatically charged to the billing source authorized by you. Should you wish to discontinue your membership for any reason and terminate further billing, you may do so by notifying us of your cancellation in writing or by calling us at the toll free number in your membership kit and by returning your membership card to us.
ADMINISTRATION
Family Healthcare Discount Plan is administered by Discount Development Services, one of the largest providers of discount healthcare services in the nation. Discount Development Services is not a licensed insurer, health maintenance organization, or other underwriter of healthcare services. Discount Development Services provides a contracted network of providers to give discounts on products and services to members at the time of service.
NO REIMBURSEMENT OF PROVIDER FEES
No portion of any provider's fees will be reimbursed or otherwise paid by Discount Development Services. Discount Development Services is not licensed to provide and does not provide medical services or items to individuals. Providers contracted by Discount Development Services are solely responsible for the professional advice, treatment, products and services rendered to members and Discount Development Services disclaims any liability with respect to such matters.
COPYRIGHT
The entire contents of this site is copyrighted under the United States copyright laws. You may print and download portions of the material solely for your own non-commercial use. Any other copying, redistribution, retransmission or publication of any downloaded material, is strictly prohibited without the express written consent of Family Healthcare Discount Plan.
ILLEGAL ACTIVITIES
You may not interfere with other viewers use of the web site.
You may not post or transmit any file which contain viruses, worms, Trojan horses or any other contaminating or destructive features.
You may not post or transmit charity requests, petitions for signatures, chain letters or letters relating to MLM or pyramid schemes. You may not post or transmit any advertising or promotional materials or any other solicitation to viewers of the web site for goods or services.
You may not use the facilities and capabilities of the web site to conduct any activity or solicit the performance of any illegal activity or other activity that infringes the rights of others.
GOVERNING LAW
These terms and conditions shall all be governed and construed in accordance with the laws of the State of California. You agree that any legal action or proceeding between this site and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in California. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Our company's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Our company may assign its rights and duties under this Agreement to any party at any time without notice to you.
